Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was held in federal custody.

In her order, the court pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court proceedings involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in the state of Tennessee.
